Preamble

These Terms and Conditions of Sale (“Terms”) define the contractual relationship between ÉDITIONS CAHIERS D’ART, and any natural or legal person (“the Customer”) placing an order via the website www.cahiersdart.com (the “Site”).

Purchasing from the Site implies full and unconditional acceptance of these Terms. Customers are invited to read them carefully before any purchase.

Éditions Cahiers d’Art undertakes to treat all personal data with strict confidentiality, in accordance with its Privacy Policy and the General Data Protection Regulation (EU) 2016/679 (GDPR).

Article 2 – Scope and Acceptance

These Terms govern the online sale of all goods offered on the Site, including but not limited to books, revues, limited editions, objects, prints, and artworks.
By confirming an order, the Customer acknowledges having read, understood, and accepted these Terms without reservation.

Cahiers d’Art reserves the right to modify these Terms at any time. The applicable version is that in force on the date the order is placed.


Article 3 – Prices

All prices are listed by default in euros (€), inclusive of VAT where applicable, and exclusive of shipping and handling costs, which are displayed at checkout before payment. Prices can be shown in other currencies available on the website.

For orders shipped outside the European Union, customs duties, import taxes, VAT or local fees may apply and are the sole responsibility of the Customer.

Prices may be updated at any time. However, confirmed orders remain subject to the prices in effect at the time of purchase.

Products remain the property of Cahiers d’Art until full payment is received.


Article 4 – Orders

Orders are placed via the Site and validated once payment has been successfully completed.
The order confirmation email sent by Cahiers d’Art constitutes acceptance of the order and confirmation that it will be processed, subject to product availability.

Cahiers d’Art reserves the right to refuse or cancel an order in the event of:

  • Product unavailability,

  • Payment authorization failure,

  • Obvious pricing or listing error,

  • Fraudulent or suspicious activity.

For subscriptions, the Customer agrees to purchase the number of issues specified in the subscription offer. Subscriptions are not time-based but issue-based.


Article 5 – Availability

Products are offered while stocks last.
If an ordered product is unavailable, the Customer will be notified by email and offered:

  • A replacement item of equal value, or

  • A full refund, within 14 days of notification.


Article 6 – Delivery

Orders are delivered to the address provided by the Customer during checkout.
Cahiers d’Art cannot be held responsible for non-delivery due to incomplete or incorrect address information.

Delivery times vary depending on destination and carrier but shall not exceed 30 days from order confirmation, unless otherwise agreed.

For subscriptions, issues are delivered as they are published.

In case of late delivery exceeding 7 days beyond the stated date, the Customer may cancel the order in writing. Cahiers d’Art will issue a full refund within 14 days of receiving the returned product, if applicable.

If the parcel appears damaged or opened upon delivery, the Customer must immediately notify the carrier and Cahiers d’Art to preserve the right to refund or exchange.


Article 7 – Payment

Payments are made in euros (€) via secure online payment using accepted credit cards (Visa, MasterCard, American Express) through Shopify Payments, which complies with PCI-DSS security standards.

Payment is processed immediately upon confirmation of the order. A purchase invoice will accompany the parcel or be sent electronically.

Cahiers d’Art retains ownership of the goods until full payment is received.


Article 8 – Security of Transactions

The Site uses SSL encryption and secure HTTPS connections to protect transaction data.
Cahiers d’Art does not store credit card information.

While all reasonable precautions are taken, the Customer acknowledges that online data transmission cannot be guaranteed to be completely secure and transmits personal data at their own risk.


Article 9 – Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has 14 calendar days from the date of receipt of the goods to exercise the right of withdrawal without needing to provide a reason.

To exercise this right, the Customer must notify Cahiers d’Art at: contact@cahiersdart.co

Returned products must be in perfect condition, unused, and in their original packaging, with proof of purchase enclosed.
The return shipping costs are borne by the Customer.

Refunds are issued within 14 days of the withdrawal notice or the product’s return, using the same payment method.

Exceptions:
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:

  • Limited or numbered editions,

  • Custom-made or personalized items,

  • Sealed products unsealed after delivery,

  • Periodical publications (revues).


Article 10 – Legal Warranties

Products are covered by the legal warranty of conformity (Articles L217-3 to L217-17 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the Civil Code).

In case of defect or non-conformity:

  • The Customer must notify Cahiers d’Art promptly by email;

  • Cahiers d’Art will repair, replace, or refund the product at no cost to the Customer.

The warranty does not apply in cases of misuse, negligence, or force majeure.


Article 11 – Liability

Cahiers d’Art shall not be liable for:

  • Non-performance due to the Customer,

  • Unforeseeable or unavoidable third-party acts,

  • Cases of force majeure (as defined by French courts).

Cahiers d’Art cannot be held liable for technical issues inherent to internet use (connection failure, virus, etc.).

The total liability of Cahiers d’Art shall not exceed the total amount paid for the disputed order.


Article 12 – Force Majeure

Neither party shall be held liable for any failure or delay in performing obligations due to circumstances beyond its reasonable control, including but not limited to:
natural disasters, epidemics, strikes, terrorism, governmental action, or disruption of transport or communication services.


Article 13 – Intellectual Property

All texts, images, designs, and other content on cahiersdart.com are the exclusive property of Éditions Cahiers d’Art or used with permission.
Any reproduction, distribution, modification, or use for commercial purposes without written authorization is strictly prohibited.


Article 14 – Personal Data

Cahiers d’Art processes personal data in accordance with the General Data Protection Regulation (EU 2016/679) and the French Data Protection Act (Loi Informatique et Libertés).

Data are collected for order management, payment, and customer relations.
Customers have the right to access, rectify, delete, and object to processing of their data.

Article 15 – Cookies

The Site uses cookies to enhance user experience and analyze traffic.
Cookies requiring consent are only installed after the Customer has explicitly accepted them.
Users can withdraw consent or change settings at any time through their browser or the Site’s cookie banner.


Article 16 – Evidence and Archiving

Electronic records stored securely by Cahiers d’Art constitute proof of transactions, orders, and payments between the parties, in accordance with Article L213-1 of the French Consumer Code.

Invoices are archived for a minimum of five (5) years on reliable media.


Article 17 – Disputes and Governing Law

These Terms are governed by French law.
In the event of a dispute, the Customer is encouraged to first seek an amicable resolution with Cahiers d’Art.

Failing that, the courts of Paris, France shall have exclusive jurisdiction.
